§ 1. guest accommodation contract The guest accommodation contract is deemed to have been concluded when the holiday flat has been booked by the guest, confirmed by the landlord and the advance payment of the booking price has been made. Both the written and the short-term verbal form are binding for the confirmation. The guest accommodation contract obliges the guest and landlord to comply and is only concluded between the landlord and guest and the persons accompanying them. The tenant is not permitted to sublet the rented property or otherwise allow or make it available for use by third parties. Unauthorised accommodation of third party guests will be charged at twice the basic accommodation rate.
§ 2 Payment Payment of the booking price shall be made online upon booking.
§ 3. cancellation In the event of cancellation 30 to 11 days before arrival, 50% of the rent will be charged. From the 10th day before arrival we charge 75% of the price if a new rental could not be made in the booked period.
§ 4. Arrival and departure times On the day of arrival, the booked holiday flat is available to the guest from 3 pm. On the day of departure, the guest must leave the holiday flat by 12 noon to give the landlord the opportunity to prepare it for the next guest. Deviations are only possible after consultation with the landlord.
§ 5 Condition of the rented property The rented property shall be handed over to the tenant in a clean and contractually compliant condition. If there are any defects or the inventory is incomplete at the time of handover, the tenant must notify the key holder/landlord immediately. Otherwise, the rented property shall be deemed to have been handed over in perfect condition. The tenant must give the landlord the opportunity to rectify any defects at any time. On moving out, the flat must be handed over in its original and tidy condition. Final cleaning is included. If damage or loss occurs in the flats caused by the guest, the guest shall be liable for this; the guest shall be liable for all persons accompanying him/her.
§ 6 Key safekeeping The recipient of the key is responsible for its safekeeping. He assumes liability for the use of the key received and bears the consequences resulting from the loss of the key. Any transfer of keys is prohibited, particularly in the interests of the authorised key holder.
§ 7 Service charges Service charges (such as electricity, water, heating, etc.) are included in the rental price.
§ 8 W-LAN W-LAN is available to our guests free of charge.

§ 11. place of jurisdiction The place of jurisdiction is the place of business, i.e. the place where the holiday flat or holiday home is located and where the service from the guest accommodation contract is to be provided, in this case the Osnabrück District Court.
§ 12. severability clause Should one or more provisions of these GTC become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
